Step 1: Ensure Your Will Can Be Located

If your will cannot be found, your estate will be distributed according to the often inflexible intestacy rules of your state of residence. One consequence is that charities will not receive any gifts that you may intend through your will.

For that reason, it is important to keep your original will in either an attorney’s vault or a bank vault if the bank is acting as executor. Keeping your will in a safe-deposit box can create delays because many states restrict access to such boxes without court approval.
